{"id":4030,"date":"2021-08-05T19:21:40","date_gmt":"2021-08-05T23:21:40","guid":{"rendered":"https:\/\/aaapg.net\/?p=4030"},"modified":"2021-08-05T19:52:39","modified_gmt":"2021-08-05T23:52:39","slug":"making-a-legally-valid-complaint-about-a-guardian-in-florida","status":"publish","type":"post","link":"https:\/\/aaapg.net\/making-a-legally-valid-complaint-about-a-guardian-in-florida\/","title":{"rendered":"Making a legally valid complaint about a guardian in Florida"},"content":{"rendered":"\n<p><strong>FILING A LEGALLY SUFFICIENT COMPLAINT AGAINST A GUARDIAN<\/strong><\/p>\n\n\n\n<p>In order to create and successfully submit a legally sufficient complaint which is likely to be accepted as valid against a guardian to OPPG or any other investigative agency, you must construct the complaint to conform to a specific style.<\/p>\n\n\n\n<p>General Instructions on how and where to file complaints is found at:<\/p>\n\n\n\n<p><a href=\"https:\/\/elderaffairs.org\/programs-services\/office-of-public-professional-guardians-oppg\/file-a-complaint\/\">https:\/\/elderaffairs.org\/programs-services\/office-of-public-professional-guardians-oppg\/file-a-complaint\/<\/a><\/p>\n\n\n\n<p><strong>Be very concise and specific.<\/strong> <strong>Do not check more than 2-3 of the specific boxes below per complaint. More than that will make your complaint much more difficult to investigate properly and therefore far less likely to succeed. If there are more violations than that, you will have an opportunity to either add on later, especially if the first complaints are verified, or to file another complaint down the road.<\/strong> <strong>Make it easy for the investigator to zero in on an offense they can prove took place.<\/strong> The trick is to help the investigator confirm your initial allegations as quickly as possible.<\/p>\n\n\n\n<p>Do not make broad sweeping complaints (i.e.,The guardian is cruel). Your complaint must be very fact specific and each allegation in it must be connected to a specific violation of a statute. \u00a0You should include:<\/p>\n\n\n\n<ul><li>Who committed the violation<\/li><li>Your detailed description of the violation\u2014what did you see or hear or learn?<\/li><li>The date(s) and time(s) of the violation<\/li><li>Where the violation took place<\/li><li>Any and all Witnesses to the violation or pattern of violations<\/li><li>Objective Evidence of the violation (photos, recordings, reports, testimony, police reports)<\/li><li>The precise statute or adminsitrative rule you feel was violated<\/li><\/ul>\n\n\n\n<p><strong>Guardianship supervision is governed by the Florida Administrative code rules found at<\/strong><\/p>\n\n\n\n<p><strong><a href=\"https:\/\/casetext.com\/regulation\/florida-administrative-code\/department-58-department-of-elder-affairs\/division-58m-office-of-public-and-professional-guardians\/chapter-58m-2-guardianship\/section-58m-2009-standards-of-practice\">https:\/\/casetext in violation of ______.com\/regulation\/florida-administrative-code\/department-58-department-of-elder-affairs\/division-58m-office-of-public-and-professional-guardians\/chapter-58m-2-guardianship\/section-58m-2009-standards-of-practice<\/a><\/strong><\/p>\n\n\n\n<p><strong>You should familiarize yourself with these standards and make reference to the specific standard that you feel has been violated.<\/strong><\/p>\n\n\n\n<p><strong>Additionally, Florida Law (Statute 744) also describes specific actions that are violations of the Law.<\/strong><\/p>\n\n\n\n<p><strong>The Statute (744) &nbsp;states\u2003Complaints; disciplinary proceedings; penalties; enforcement:<\/strong><\/p>\n\n\n\n<p>(a)\u2003. <em>A complaint is legally sufficient if it contains ultimate facts that show a violation of a standard of practice by a professional guardian has occurred<\/em><\/p>\n\n\n\n<p>The most frequent statute violations are in RED<\/p>\n\n\n\n<p><strong>744.3215\u2003Rights of persons determined incapacitated .<\/strong>\u2014<\/p>\n\n\n\n<p>(1)\u2003A person who has been determined to be incapacitated <strong><u>retains the right<\/u><\/strong><strong><u>:<\/u><\/strong><\/p>\n\n\n\n<p>(a)\u2003To have an annual review of the guardianship report and plan <\/p>\n\n\n\n<p>(b)\u2003To have continuing review of the need for restriction of his or her rights <\/p>\n\n\n\n<p>(c)\u2003To be restored to capacity at the earliest possible time <\/p>\n\n\n\n<p>(d)\u2003To be treated humanely, with dignity and respect, and to be protected against abuse, neglect, and exploitation<\/p>\n\n\n\n<p>(e)\u2003To have a qualified guardian <\/p>\n\n\n\n<p>(f)\u2003To remain as independent as possible, including having his or her preference as to place and standard of living honored, either as he or she expressed or demonstrated his or her preference prior to the determination of his or her incapacity or as he or she currently expresses his or her preference, insofar as such request is reasonable<\/p>\n\n\n\n<p>(g)\u2003To be properly educated <\/p>\n\n\n\n<p>(h)\u2003To receive prudent financial management for his or her property and to be informed how his or her property is being managed, if he or she has lost the right to manage property <\/p>\n\n\n\n<p>(i)\u2003To receive services and rehabilitation necessary to maximize the quality of life <\/p>\n\n\n\n<p>(j)\u2003To be free from discrimination because of his or her incapacity<\/p>\n\n\n\n<p>(k)\u2003To have access to the courts <\/p>\n\n\n\n<p>(l)\u2003To counsel <\/p>\n\n\n\n<p>(m)\u2003<strong>To receive visitors and communicate with other<\/strong>s<\/p>\n\n\n\n<p>(n)\u2003To notice of all proceedings related to determination of capacity and guardianship, unless the court finds the incapacitated person lacks the ability to comprehend the notice <\/p>\n\n\n\n<p>(o)\u2003To privacy <\/p>\n\n\n\n<p>(2)\u2003Rights that may be removed from a person by an order determining incapacity but not delegated to a guardian include the right:<\/p>\n\n\n\n<p>(a)\u2003To marry in violation of ______. If the right to enter into a contract has been removed, the right to marry is subject to court approval in violation of ______.<\/p>\n\n\n\n<p>(b)\u2003To vote <\/p>\n\n\n\n<p>(c)\u2003To personally apply for government benefits <\/p>\n\n\n\n<p>(d)\u2003To have a driver license<\/p>\n\n\n\n<p>(e)\u2003To travel <\/p>\n\n\n\n<p>(f)\u2003To seek or retain employment <\/p>\n\n\n\n<p>(3)\u2003Rights that may be removed from a person by an order determining incapacity and which may be delegated to the guardian include the right:<\/p>\n\n\n\n<p>(a)\u2003To contract <\/p>\n\n\n\n<p>(b)\u2003To sue and defend lawsuits <\/p>\n\n\n\n<p>(c)\u2003To apply for government benefit<\/p>\n\n\n\n<p>(d)\u2003To manage property or to make any gift or disposition of property <\/p>\n\n\n\n<p>(f)\u2003To consent to medical and mental health treatment <\/p>\n\n\n\n<p>(g)\u2003To make decisions about his or her social environment or other social aspects of his or her life<\/p>\n\n\n\n<p>(4)\u2003Without first obtaining specific authority from the court, as described in &nbsp;744.3725, a guardian may not:<\/p>\n\n\n\n<p>(a)\u2003Commit the ward to a facility, institution, or licensed service provider without formal placement proceeding, pursuant to chapter 393, chapter 394, or chapter 397.<\/p>\n\n\n\n<p>Following is a sample form to cocomplete and copy. rapidly downspent to the benefit of the Guardian and her associatesand in particular are being hoarded for the purpose of paying outrageous Guardian\u2019s bills and excessive improper legal bills from the Guardian\u2019s Attorneys and others, leaving the Ward bereft of a lifetime\u2019s accumulation of assets and destitute in violation of ______.<\/p>\n\n\n\n<p>[ ] Assets are being sold off to associates of the Guardian at far below market value and then resold at great profit to the Guardian and her associates\u2014these are overt acts of felonious self-dealing in violation of to\/from the estate in violation of ______.<\/p>\n\n\n\n<p>[ ] Guardian colluded with one side of family dispute to abet the legal abuse in violation of ______.<\/p>\n\n\n\n<p>[ ] Guardian failed to properly use mediation to avoid litigation in violation of ______.<\/p>\n\n\n\n<p>[ ] Guardian abused mediation process since those discussions are privileged in violation of ______.<\/p>\n\n\n\n<p>[ ] Guardian hid misdeeds under guise of privacy issues in violation of ______.<\/p>\n\n\n\n<p>[ ] Guardian blackmailed family members into signing releases in violation of ______.<\/p>\n\n\n\n<p>[ ] The Guardian and her Attorney have repeatedly staged retaliatory litigation to<\/p>\n\n\n\n<p>increase their revenue at the expense of the estate and family in violation of ______.<\/p>\n\n\n\n<p>[ ] Guardian threatened family members that any complaints about the Guardianship would lead to their never seeing their loved one again in violation of ______.<\/p>\n\n\n\n<p>[ ]
